When using the web and social media, private web addresses must be kept separate from public web addresses in order to maintain the business owner&#8217;s professional image.</p>
<p>Distinct <a href="http://www.uk2.net/domain-names/">domain names</a> for both personal and professional websites are a requirement. When a business owner&#8217;s name is too similar to the name of the business, then clients searching for a business online may be led to private photos or other private communications. When owners register separate domain names, they ensure that clients are not exposed to material that is irrelevant to the products and services offered by the business.</p>
<p>Many business owners blog for both business and private audiences. These bloggers must be absolutely sure that their professional and personal blog addresses are completely different. For example, if WordPress hosts both blogs, the web addresses must be different enough that clients will not find the business owner&#8217;s personal blog. Either way, using completely separate services ensures that neither private nor public contacts are ever misdirected.</p>
<p>Facebook, in particular, should be used with care. To guarantee freedom and reputation, business owners should create different private and occupational domains. A private domain for the business and a separate page for personal use will guarantee that the line between friend and client does not blur. <p>In today&#8217;s interconnected world, keeping private and work-related communication separate is increasingly difficult. However, to ensure both freedom and a solid reputation, website owners should take great care with domain registration. <p>List building is a topic which I have been following for over 10 years or more. In that time, you pick up a lot of helpful information when it comes to building your own opt-in email list. With the recent advent of such social networks like Twitter, Facebook, Google+&#8230; list building has grown in importance, rather than diminished. </p>
<p>Granted, the effectiveness of using email as a marketing tool doesn&#8217;t hold the same power as it once did when it was a new medium. Most web users have now become wary of receiving too many emails and/or open fewer and fewer emails, regardless of the subject matter. These subscribers are also more likely to unsubscribe from your list if your emails become too promotional.</p>
<p>Regardless of this fact, most savvy online marketers will have &#8220;follow-up&#8221; marketing funnels or lists in place for the products and services they&#8217;re promoting. Instead of just having one chance to &#8220;sell&#8221; to a potential customer, if that person subscribes to receive additional information, you will have countless chances to promote your products. In a similar way, most of these marketers will have a general opt-it list, where they promote different related products. For example, if you have a site on Internet marketing tools, you could build a list full of readers interested in marketing tools.</p>
<p>Social Networks Changes Everything</p>
<p>As a way of promoting my sites, I have several YouTube channels and I am constantly surprised to find that some pimply faced kid has several million subscribers. Some of these kids are not even out of high school and they&#8217;re racking up millions of views and getting 1000s of new subscribers each day. The list building power of a system like YouTube should not be underestimated. Most of these same kids have partnered with YouTube and earn daily sums that would shock many people. Perhaps the only drawback, your subscribers or Twitter followers may be subscribed to hundreds of other Tweeters, so your message might get lost in the onslaught. Regardless, Twitter is a &#8220;must-have&#8221; program for any online marketer or webmaster who is interested in building their lists.</p>
<p>Another new-comer to the whole social networking scene is Google+ and it has quickly become important for several reasons. One it is from Google, perhaps one of the most respected brands in the world. Second, Google has just recently integrated Google+ profiles and posts into their personal search results when a user is logged into their G account. This second factor really opens up Google+ as a list building property because you can now use the power of Google&#8217;s search engine to promote your profile and posts to build your list of contacts.</p>
<p>However, the grand-daddy of all social list building programs simply has to be Facebook. One can use this premium social network in many ways&#8230; build a fan base for your website or product, build a list of close business colleagues or build a list of close family members and friends&#8230; Facebook is the ultimate online list builder. What is really significant here is Facebook&#8217;s large member base &#8211; close to 900 million users and will probably reach a billion users soon.<br />
This opens up a whole pool of prospective subscribers which is much larger than Google+ and besides Facebookers stay logged into their accounts twice as long as those using Google. This makes Facebook users much more active and more likely to stumble across your own Facebook page or fan site. </p>

			<content:encoded><![CDATA[<p>As it sounds, content curation is the process of filtering and sorting through information prior to sharing it with your community, fans, and followers. Content curation is a hot topic in the marketing arena, and reflects a growing emphasis on finding, highlighting, and sharing good content.</p>
<p>The key hallmark, to my mind, that separates content curation from simple sharing is that content curation usually involves an addition of comments or more information from the one who is curating, where a simple share is just a repeat of what the original poster originally shared.</p>
<p>As an example, when re-tweeting someone on Twitter or sharing their updates on Facebook it is regarded as a straight share.. Where a simple share becomes a form of content curation is when I add my own comments or thoughts to the retweet or share. Something like, &#8220;Very good article&#8221; or &#8220;I&#8217;m attending this event, I hope you will too.&#8221;</p>
<p>These types of additions serve primarily a social/relational function. A powerful form of content curation happens when you mention another person&#8217;s article and incorporate your strategies or advice into it. This becomes a way of filtering information and presenting the best of it to your community. It places you in a thought leadership position.</p>
<p>Introducing content by filtering is an influential building process. As the rate of content production increases and people feel more and more overwhelmed by information, the most influential leaders will be the ones who filter best. Stated another way, you can gain some measure of influence and leadership over a community, simply by being a very strong filter of information specific to that community.</p>
<p>A better way to become a influencer is to create and curate your own content. You can build your thought leadership by developing relevant, timely, unique and captivating content that serves your target audience. You can curate your own content periodically by reintroducing a valuable post, or reigniting the conversation around a particular topic.</p>

<p> It is tempting for new websites to grab a Terms of Use document from a similar website and just modify it for their purposes. Once Terms of Use are prepared and uploaded, modifying them to address issues that were initially either overlooked or misunderstood may not be a simple or inexpensive matter.</p>

<p> KEY PROVISIONS</p>
<p> Following are some of the main issues that need to be considered when preparing Terms of Use.</p>
<p> ESTABLISHING ENFORCEABILITY. It may seem obvious, but Terms of Use need to be enforceable against the users. Enforceability will often hinge on how users express their assent to the Terms of Use. On one end of the spectrum, Terms of Use can just be posted on a website without requiring users to take any action to accept them. This approach will be least enforceable. On the other end, a user could be compelled to view and affirmatively accept the Terms of Use before being allowed to access the website. There are also various options in between. Several factors need to be considered before selecting the right approach, including balancing liability risks with the impact on the user experience. It is important to note that the method by which users are notified of modifications to Terms of Use will also determine whether such modifications are binding upon the users.</p>
<p> RULES APPLICABLE TO USER CONDUCT. The Terms of Use need to define acceptable and unacceptable behavior. For instance, the Terms of Use should (i) define proper and acceptable interaction with other users, (ii) define the guidelines for content that users are permitted to upload, (iii) restrict users to personal use or also allow commercial use, (iv) prohibit data harvesting or data mining, (v) prohibit unsolicited emailing or marketing, (vi) prohibit unauthorized manipulation of the services, (vii) prohibit impersonation or fictitious profiles, etc.</p>
<p> RULES APPLICABLE TO USER-GENERATED CONTENT. When users can upload content to a website, the rights and ownership relating to such content must be defined. For instance, does the website have ownership or at least license rights to comments and discussions, images, videos? License rights must be carefully drafted, because rights not specifically granted will be deemed retained by the user. So if a website wants to be able allow video or other content to be posted on other related sites or otherwise transferred, the website will need these rights expressly granted by the users. Also, a website will want the right to remove for any or no reason any content that it deems in appropriate. Without this express right, a website could face liability from a user. If the website wants to expand its use rights after initial Terms of Use are uploaded, it may be difficult to have the expanded rights apply to user-generated content uploaded prior to the effective date of the version containing the expanded rights.</p>
<p> PRESERVE OWNERSHIP RIGHTS IN CONTENT. Content can come from two sources: (i) website originated content and (ii) user-generated content. The Terms of Use should establish the website ownership in content and limit how users are permitted to use that content.</p>
<p> PROVISIONS DESIGNED TO BENEFIT WEBSITE FROM STATUTORY IMMUNITIES AND ACHIEVE COMPLIANCE WITH LEGAL REQUIREMENTS. Certain provisions are required to be in a Terms of Use to receive immunity for copyright infringement under the Digital Millennium Copyright Act. Similarly, Terms of Use can include language providing that the users provide affirmative consent to receiving direct marketing materials from the website or third parties. This will serve to avoid the opt-out provisions of the CAN-SPAM Act. Additionally, the law requires specific procedures for collecting personal information from children under the age of 13 in accordance with the Children&#8217;s Online Privacy Protection Act (COPPA).</p>
<p> PROVISIONS DESIGNED TO POSITION WEBSITE TO INITIATE ENFORCEMENT ACTIONS. It is important that a website has broad discretion to terminate a user&#8217;s right to access the website when violating the Terms of Service or otherwise behaving in a manner that might harm the website or other users. There are also various laws that a website will be better positioned to take advantage of if certain provisions are contained in the Terms of Use. For instance, an express prohibition of sending unauthorized emails to other users will improve the ability of the website to take immediate legal action for common law trespass and a violation of the Computer Fraud and Abuse Act, and other laws that require a showing of unauthorized access. Additionally, establishing and limiting rights to use copyrighted content will undercut an infringer&#8217;s defense that there is an implied license for liberal use of the website content.</p>
<p> DISCLAIMER OF WARRANTIES. Users may come to rely on the performance or services offered by a website. It is therefore important that the Terms of Use clarify that the website makes no warranties as to performance, availability, quality, correction of errors or accuracy of information. Enforceability of such a provision may depend upon the jurisdiction.</p>
<p> LIMITATION OF LIABILITY. A failure in performance might result in users incurring some kind of a loss or damage. Therefore, it is critical that users agree that the website has only limited liability in terms of the types of damages and the total amount of damages incurred by a user. Enforceability of such a provision may depend upon the jurisdiction.</p>
<p> CHOICE OF LAW/VENUE. If there is a dispute between a user and a website, the website would want to be able to choose what laws apply and where any disputes will be conducted. Defending an action in a distant location could put a significant financial burden on a website.</p>
